GABRIELLE UNION SUED

Gabby finally gets called out.



The NY Daily News reports that Dwyane Wade's bitter divorce battle from Siohvaughn Funches has become a whole lot messier.

The estranged wife of the NBA star is seeking $50,000 in damages against his new girlfriend, actress Gabrielle Union, whom she alleges has caused her two children emotional distress.

Funches claims the actress "engaged in sexual foreplay" with Wade in front of his sons, Zaire, 8, and Zion, 2, while on an unsupervised visit to his Miami home, according to the Chicago Sun-Times.

The suit also alleges that Wade's oldest son was allowed to play unsupervised in or around the Miami home's pool at night. Wade and Union allegedly ignored the child, whose "screams and cries" eventually caught the attention of Wade's mother, Jolinda Wade.

In addition, the suit claims the younger son nearly drowned while in Wade's care.

Wade allegedly orchestrated a meeting between Union and his children, where he introduced her as his "girlfriend" and said "that is why your mom and I are going to divorce," according to the suit.

Funches claims Union's "extreme and outrageous conduct" with Wade has caused her oldest son to seek medical treatment for stress and anxiety, as well as develop nervous habits, headaches and hair loss.

Wade, 28, recently filed for sole custody of the couple's two sons, a move which reportedly prompted Funches to add Union to the lawsuit, reports Gossip Cop.

He says he is "shocked" by the "baseless and meritless" lawsuit filed by his ex.

"I am deeply saddened and disappointed that Siohvaughn has used our sons once again as pawns and is now lashing out at Gabrielle, who is an innocent party," Wade tells TMZ.com. "It is clear that this is a desperate attempt to retaliate against me for seeking sole custody of our children and requesting that the court have her undergo a psychiatric examination."

He adds, "My primary concern is my children and actions such as this only inflame the situation and are harmful to their well being."

A rep for Union, 37, also denies the claims, saying, "Each and every allegation made is entirely false."

"These false accusations were previously made approximately one month ago in family court. Not only was Ms. Union not named a defendant at that time but the court ultimately rejected these claims as frivolous," the rep added. "Gabrielle apologizes to the Circuit Court of Cook County, Illinois for tying them up with erroneous claims when there are real victims who should be receiving the legal attention they need."
